DUSTY’Z RV REPAIR
TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern services provided by Dusty’z RV Repair (“Dusty’z,” “we,” “us,” or “our”). By scheduling service, paying a service-call fee or deposit, signing or electronically approving an estimate, work order, or invoice, or otherwise authorizing work, the customer (“Customer”) acknowledges and agrees to these Terms.
These Terms apply together with any estimate, work order, repair authorization, invoice, warranty document, or other written agreement issued by Dusty’z RV Repair.
1. REPAIR AUTHORIZATION
Customer authorizes Dusty’z RV Repair to perform the inspections, diagnostics, repairs, installations, maintenance, and other services specifically described in the approved estimate, work order, or invoice.
Authorization may be provided by handwritten or electronic signature, text message, email, electronic approval, or other written electronic communication.
Authorization for inspection or diagnosis does not automatically authorize repairs not included in the approved scope.
When additional work is discovered, Dusty’z RV Repair will obtain Customer authorization before performing work that materially exceeds the approved scope.
2. SERVICE-CALL & DIAGNOSTIC FEES
Service-call and diagnostic fees are non-refundable and are due before the scheduled on-site visit unless otherwise agreed in writing.
These fees compensate Dusty’z RV Repair for scheduling, travel, technician time, inspection, testing, troubleshooting, and/or diagnosis.
Service-call and diagnostic charges are separate from repair labor, parts, materials, shipping, and other charges unless specifically stated otherwise.
Payment of a service-call or diagnostic fee does not guarantee:

The RV can be repaired during the initial visit;

The required parts are immediately available;
-
A particular component can be repaired rather than replaced; or
-
Additional diagnosis will not be required.
Diagnostic fees compensate Dusty’z RV Repair for the diagnostic service performed and are not contingent upon Customer approving the recommended repair.
3. ESTIMATES
Estimates are based on the information and conditions reasonably available at the time they are prepared.
Unless expressly stated otherwise in writing, an estimate is not a guarantee that the final cost will not change if additional problems, parts, labor, or concealed conditions are discovered.
RV systems frequently require disassembly or testing before the complete extent of a failure can reasonably be determined.
Dusty’z RV Repair will communicate material changes to the scope of work and obtain Customer authorization before performing additional repairs outside the approved scope.
4. HIDDEN & PRE-EXISTING CONDITIONS
Customer acknowledges that RVs may contain concealed or pre-existing conditions that cannot reasonably be identified before diagnosis or disassembly, including:

Water intrusion and hidden water damage;

Wood or structural deterioration;
-
Mold or moisture-related deterioration;
-
Corrosion;
-
Damaged or overheated wiring;
-
Plumbing leaks;
-
Brittle plastic or trim;
-
Deteriorated seals and sealants;
-
Damaged fasteners;
-
Previous improper repairs;
-
Unauthorized modifications;
-
Manufacturer defects;
-
Roof or wall deterioration; and
-
Other concealed mechanical, electrical, structural, or cosmetic conditions.
Dusty’z RV Repair will exercise reasonable care while performing authorized services but is not responsible for pre-existing damage, concealed defects, normal deterioration, manufacturer defects, or unrelated failures.
Additional repairs resulting from such conditions are outside the original scope unless specifically included in the approved estimate.
5. AGED & DETERIORATED COMPONENTS
Customer acknowledges that RV components exposed to age, heat, sunlight, moisture, vibration, weather, or previous repairs may become brittle, seized, corroded, deteriorated, or weakened.
Reasonable removal, disassembly, testing, diagnosis, or repair may expose or cause an already weakened component to break or fail.
This may include trim, seals, fasteners, roofing materials, wiring, plumbing fittings, plastic components, cabinetry, slide components, appliances, and other materials.
When such failure results from an existing or concealed condition rather than Dusty’z RV Repair's failure to exercise reasonable care, necessary replacement or additional repair is not included in the original scope and may result in additional charges.
6. DEPOSITS
Repairs, installations, or projects with an estimated total exceeding $500 require a 30% deposit before parts are ordered or the project is scheduled unless otherwise agreed in writing.
Deposits are credited toward the final invoice.
Once parts or materials have been ordered or purchased specifically for Customer's RV, amounts attributable to non-returnable or special-order parts, shipping, freight, restocking fees, or other unrecoverable costs may be non-refundable.
Additional deposits may be required when Customer authorizes additional work or when additional parts must be ordered.
7. PARTS & MATERIALS
Dusty’z RV Repair may select appropriate replacement parts and materials consistent with the approved repair unless a specific brand, manufacturer, or part is stated in the estimate.
Replacement parts may differ cosmetically from original equipment due to manufacturer changes, discontinued products, availability, or superseded part numbers.
Parts availability, shipping delays, backorders, and manufacturer discontinuations are outside Dusty’z RV Repair's reasonable control.
8. CUSTOMER-SUPPLIED PARTS
Installation of Customer-supplied parts is at Dusty’z RV Repair's discretion.
Dusty’z RV Repair does not warrant or guarantee Customer-supplied parts for:

Quality;
-
Condition;
-
Compatibility;
-
Correct application;
-
Completeness;
-
Performance; or
-
Manufacturer defects.
Customer remains responsible for labor performed even if a Customer-supplied part proves defective, incorrect, or incompatible.
Additional labor required to diagnose, remove, modify, or replace an incorrect or defective Customer-supplied part may be charged separately.
Unless expressly agreed otherwise in writing, Dusty’z RV Repair's labor warranty does not cover labor necessary to replace a failed Customer-supplied part.
9. LABOR WARRANTY
Unless otherwise stated in writing, Dusty’z RV Repair provides a 90-day limited warranty on qualifying labor performed by Dusty’z RV Repair, beginning on the date the applicable repair is completed.
This warranty applies only to the specific labor originally performed.
The labor warranty does not cover failures resulting from:

Customer-supplied parts;
-
Manufacturer or component defects;
-
Normal wear and deterioration;
-
Misuse or abuse;
-
Neglect or lack of maintenance;
-
Improper operation;
-
Accidents or impact damage;
-
Weather or environmental conditions;
-
Water intrusion unrelated to the warranted repair;
-
Electrical supply problems;
-
Unauthorized modifications;
-
Subsequent repairs or alterations performed by another person;
-
Pre-existing or concealed conditions; or
-
Systems or components unrelated to the original repair.
Customer must provide Dusty’z RV Repair a reasonable opportunity to inspect an alleged warranty issue before another repair provider performs corrective work.
10. PARTS WARRANTIES
Parts and components are subject to the applicable manufacturer's warranty, if any.
Dusty’z RV Repair does not independently extend or enlarge a manufacturer's warranty unless expressly stated in writing.
Manufacturer warranty approval, replacement, reimbursement, shipping, and processing are subject to the manufacturer's requirements.
Labor associated with removing or replacing a manufacturer-warranted component is not automatically covered unless the manufacturer or Dusty’z RV Repair specifically agrees to cover that labor.
11. PAYMENT
Unless otherwise agreed in writing, payment is due immediately upon completion of authorized services.
For mobile service, the balance must be paid before the technician departs the service location.
Customer is responsible for all authorized labor, parts, materials, service-call fees, diagnostic charges, shipping, and other approved charges.
Customer may not withhold payment for properly completed authorized work solely because additional or unrelated repairs are recommended.
12. PAST-DUE BALANCES
Past-due balances may accrue a finance charge of 1.5% per month (18% annually), or the maximum amount permitted by applicable law, whichever is lower.
To the extent permitted by law, Customer agrees to pay reasonable costs associated with collecting delinquent amounts, including collection expenses, court costs, and reasonable attorney's fees.
Dusty’z RV Repair reserves all lien, possessory, contractual, and collection rights available under applicable Texas law.
13. RETURNED PAYMENTS & PAYMENT DISPUTES
Returned checks or other payments returned for insufficient funds may be subject to a $35 handling fee, to the extent permitted by law, plus actual bank or processing charges.
A payment reversal, dispute, or chargeback does not eliminate Customer's responsibility for legitimate charges arising from authorized services actually performed.
Customer agrees to contact Dusty’z RV Repair promptly regarding billing concerns so that the matter can be reviewed.
14. CANCELLATIONS & RESCHEDULING
Customers should provide reasonable notice when cancelling or rescheduling an appointment.
Service-call fees, deposits, parts already ordered, special-order materials, shipping expenses, restocking charges, or other costs already incurred may remain non-refundable as provided in these Terms.
Repeated cancellations, missed appointments, unsafe service conditions, or failure to make required payments may result in Dusty’z RV Repair declining or discontinuing service.
15. MOBILE SERVICE ACCESS
Customer is responsible for providing safe, lawful, and reasonable access to the RV.
The RV must be positioned so the technician has adequate space to safely perform the authorized work.
Dusty’z RV Repair may refuse, postpone, or discontinue work when conditions are unsafe, including severe weather, unstable surfaces, unsafe electrical conditions, aggressive animals, inadequate working clearance, hazardous materials, or other unreasonable hazards.
Additional service calls or travel required because adequate access was not available may result in additional charges.
16. CUSTOMER RESPONSIBILITIES
Customer represents that Customer owns the RV or has legal authority to authorize the requested work.
Customer agrees to provide accurate information concerning known problems, previous repairs, modifications, water intrusion, electrical problems, propane issues, accidents, or other conditions relevant to the requested service.
Customer is responsible for removing or securing valuables and personal property that may interfere with repair access.
17. INSURANCE & EXTENDED WARRANTIES
Dusty’z RV Repair may assist Customers with insurance or extended-warranty claims when agreed upon.
Approval by an insurance company or warranty administrator is not guaranteed.
Customer remains ultimately responsible for charges not paid by the insurer, warranty administrator, or other third party, including deductibles, excluded labor, diagnostic charges, service calls, shipping, upgraded parts, or non-covered repairs.
Third-party authorization or payment delays do not alter Customer's obligations unless Dusty’z RV Repair agrees otherwise in writing.
18. PHOTOGRAPHS & DOCUMENTATION
Customer authorizes Dusty’z RV Repair to photograph or otherwise document relevant portions of the RV for:

Condition documentation;
-
Diagnosis;
-
Estimates;
-
Repair records;
-
Technical assistance;
-
Insurance claims;
-
Extended-warranty claims; and
-
Warranty documentation.
Dusty’z RV Repair will not knowingly publish personally identifying Customer information for advertising without permission.
19. COMPLETION TIMES & DELAYS
Any completion date or timeframe provided is an estimate unless expressly guaranteed in writing.
Dusty’z RV Repair is not responsible for reasonable delays caused by circumstances outside its control, including weather, parts availability, shipping delays, backorders, manufacturer delays, concealed damage, insurance or warranty authorization, or unsafe working conditions.
20. LIMITATION OF RESPONSIBILITY
Dusty’z RV Repair will exercise reasonable care while performing authorized services.
To the extent permitted by law, Dusty’z RV Repair is not responsible for loss, damage, or failure caused by:

Pre-existing conditions;
-
Concealed defects;
-
Normal wear or deterioration;
-
Manufacturer defects;
-
Previous improper repairs;
-
Customer modifications;
-
Acts of nature;
-
Customer-supplied parts;
-
Conditions outside Dusty’z RV Repair's reasonable control; or
-
Systems or components unrelated to the work performed.
Repairing or diagnosing one system does not constitute an inspection, certification, or guarantee of the condition or safety of the entire RV.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
21. INDEMNIFICATION
To the extent permitted by applicable law, Customer agrees to indemnify and hold harmless Dusty’z RV Repair, its owners, employees, and agents from third-party claims, losses, or expenses resulting from Customer's lack of authority to authorize repairs, inaccurate information supplied by Customer, Customer-supplied components, unsafe conditions under Customer's control, or Customer's own acts or omissions.
This provision does not require Customer to indemnify Dusty’z RV Repair for liability that applicable law does not permit to be transferred or waived.
22. RIGHT TO REFUSE OR STOP SERVICE
Dusty’z RV Repair reserves the right to refuse, suspend, or discontinue service when reasonably necessary, including for unsafe working conditions, non-payment, threats, harassment, abusive conduct, illegal activity, material misrepresentation, or requests to perform repairs Dusty’z RV Repair considers unsafe or improper.
Customer remains responsible for authorized services and costs incurred before work is discontinued.
23. ELECTRONIC COMMUNICATION & AUTHORIZATION
Customer agrees that text messages, emails, electronic signatures, electronic estimate approvals, and similar written electronic communications may be used for repair authorization, change approvals, estimates, scheduling, and other service-related communications.
Customer is responsible for providing accurate contact information.
24. NO GUARANTEE OF UNRELATED SYSTEMS
RV systems are interconnected, and multiple failures may exist simultaneously.
Successful completion of an authorized repair means only that Dusty’z RV Repair performed the specific approved service. It does not constitute a representation that every component or system in the RV has been inspected or is free from defects.
Unless specifically included in the work order, Dusty’z RV Repair does not perform a comprehensive safety inspection of the entire RV.
25. NO WAIVER
Failure by Dusty’z RV Repair to enforce any provision of these Terms on one occasion does not waive its right to enforce that provision in the future.
26. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in effect.
27. GOVERNING LAW
These Terms and services provided by Dusty’z RV Repair are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
28. CHANGES TO THESE TERMS
Dusty’z RV Repair may update these Terms from time to time.
The version applicable to a particular repair will generally be the version in effect when Customer authorizes the applicable work, unless otherwise required by law or agreed in writing.
The current version will be maintained at dustyzrvrepair.com with a “Last Updated” date.
29. ENTIRE AGREEMENT
These Terms, together with the applicable estimate, repair authorization, work order, invoice, and any written modifications or approvals, constitute the agreement between Customer and Dusty’z RV Repair concerning the applicable services.
If a specific written term on an approved estimate or work order directly conflicts with these general Terms, the specifically agreed written term will control for that particular service.
30. CUSTOMER ACCEPTANCE
By scheduling service, paying a required service-call fee or deposit, signing or electronically approving an estimate, work order, repair authorization, or invoice, or otherwise providing written authorization for work, Customer acknowledges that Customer has had an opportunity to review these Terms and agrees to be bound by them.
